GENERAL CONDITIONS OF SALE OF THE SITE HYALURONICFILLERMARKET.COM
Preamble
LA PHARMACIE SAINT DENIS, registered in the Nanterre Trade and Companies Register under number 507 573 186 and whose address is 28 rue Saint Denis 92700 Colombes - France, is the owner of the website Hyaluronicfillermarket.com, hereinafter referred to as (SIH).
General
These general terms and conditions of sale (GTC) set out all the obligations of the parties. In this sense, the customer is deemed to accept without reservation the entirety of the provisions set out in these GTC.
Any purchase made on the HIS implies the consultation and unreserved acceptance by the customer of the entirety of the GSC.
The present CGV apply to all the sales concluded via the SIH.
LA PHARMACIE SAINT DENIS reserves the right to modify and/or complete the general conditions at any time. The general conditions of sale applicable to a sale are those in force at the day of the order on the HIS. Any other document than the present GTC has only a contractual value.
It is specified that the customer has the possibility of saving and/or printing the present GTC, which is solely his own responsibility.
Order
The contractual information e-mails, purchase orders will be considered as proof of communications, orders and payments between the parties.
We reserve the right not to validate the order in the following cases:
In case of products not available in stock. In case of order of a product which, for some reason that it is, is not available any more in stock, we inform you about it and cancel the order; In case of refusal of payment, in case of fraud or reasonable suspicion of fraud; In case of order of a significant volume of the same product or with destination of the same address of delivery; In case of abuse of the right of retractation which at the time of several preceding orders;
In all these cases of figures, the sums which will be possibly paid, will be completely refunded to you as soon as possible and the order cancelled.
Under no circumstances will any claims regarding an order be accepted after a period of two months has elapsed.
The purchase contract is concluded by sending a confirmation e-mail within two working days of receiving your order. The verification of the good reception of this email is the responsibility of the customer
Taking into account the legislations and taxes, LA PHARMACIE SAINT DENIS reserves the right to refuse an order placed from any other country than Metropolitan France.
Products
The products presented on the SIH are described in good faith and as accurately as possible.
The offers and prices are indicated in euros (€) and are valid only on the date the order is placed. They can be modified at any time without notice. They do not take into account the delivery costs, invoiced in supplement, and indicated before the validation of the order.
Only the price displayed on the SIH is authentic between the contracting parties. The prices proposed at the end of the ordering process indicate the global prices including all taxes, as well as the delivery charges and other possible charges. The prices take into account the V.A.T. applicable on the day of the order and any change in V.A.T. will automatically be reflected in the price of the products on the HIS. The payment of the totality of the price must be honored at the time of the order.
Due to the number of products and new products on the HIS, it is possible that some prices are inaccurate, and if the price indicated is obviously wrong, the customer cannot demand the conclusion of the sale at the wrong price.
The products or promotional offers presented by the SIH are valid only within the limits of available stocks.
Mode of payment
The payment methods proposed are the payment by credit card and any other payment method that the SIH will propose in the course of your order. We reserve the right to modify the available payment methods without prior notice.
LA PHARMACIE SAINT DENIS reserves the right to suspend any order and delivery in case of non payment
The prices of our products are indicated in euros including all taxes (French VAT and other applicable taxes). They include in particular the expenses of treatment of your order.
If you ask for a delivery outside the French territory, your order could be subjected to possible taxes and customs duties when it will arrive at destination.
The payment of these duties and taxes is your responsibility and we invite you to inquire with the competent authorities of your country. You must also check the possibilities of importing or using the products you order from us in the destination country.
Delivery
LA PHARMACIE SAINT DENIS commits itself as of the confirmation of forwarding of the order sent in accordance with the CGV, to deliver the ordered products to the address of delivery indicated at the time of the order.
Any anomaly concerning the delivery (damage, missing product compared to the delivery order, damaged parcel, broken products...) must be noted at the time of the delivery and after opening of the parcel in front of the conveyor and will have to be imperatively indicated on the delivery order in the form of "handwritten reserves", accompanied by the signature of the customer.
The delivery is made by parcel, by postal way or by the intermediary of a company of transport appointed by our care. In the hypothesis where, however, we could not honor the delivery period announced, for some reason that it is, LA PHARMACIE SAINT DENIS will proceed to the refunding of the order at the latest 1 month following the date of order.
The delivery periods are in general included between 2 and 10 working days. You will not be able to claim some damages consecutive to the absence of delivery in the planned time.
You will be informed of any delivery restrictions/constraints at the latest at the beginning of the order process.
All complaints relating to an error of delivery and/or nonconformity of the products in kind or in quality compared to the indications being reproduced on the purchase order must be notified to LA PHARMACIE SAINT DENIS (see co-ordinates indicated in the introduction of the present CGV or via an email: contact@hyaluronicfillermarket.com) within 2 working days with reception of the products (follow-up of the conveyor making times) with defect of which the right to the complaint will cease being acquired.
Limits of responsibility
We reserve the right to refuse an order, without our responsibility being engaged in this respect.
The customer is expressly informed that LA PHARMACIE SAINT DENIS is not the producer of the products presented on the SIH within the meaning of the law n°98-389 of May 19, 1998 and relating to the responsibility because of the defective products.
Consequently, in the event of damage caused with a person or a good by a defect of the product, only the responsibility for this one could be sought by the customer, on the basis of information appearing on the packing of the aforementioned product.
Right of withdrawal
You have the right to withdraw from your order within 7 working days to return, at your expense, the products that do not suit you. We remind you that class 3 medical devices can neither be returned nor refunded
To exercise the right of retractation, you must notify us your decision of retractation of the present contract by means of a declaration to LA PHARMACIE SAINT DENIS (see coordinates indicated in the introduction of the present CGV or via an email: contact@hyaluronicfillermarket.com).
To profit from the right of retractation, the products will not have to be opened, damaged or whose packing of origin will have been deteriorated.
In case of withdrawal from the present, we will reimburse the amount paid for your order within one month. We will proceed with the refund using the same payment method that you used for the initial transaction, unless otherwise agreed between the parties on another payment method.
Personal data
In accordance with the provisions of the French law on data processing and liberties (Law n°78-17 of January 6, 1978 modified on August 6, 2004 relating to data processing, files and liberties), each customer who has entered and registered personal information has the possibility of accessing, modifying or deleting his or her personal data by carrying out one of the two actions below:
- To modify or remove its information in the heading "My account"
- To explicitly ask LA PHARMACIE SAINT DENIS (see coordinates indicated in the introduction of the present CGV or via an email: contact@pharmaciecolombes.com).
Applicable right
The present CGV are subjected to the French law. In the event of litigation or of complaint PHARMACIE SAINT DENIS and the customer will do their best to find a resolution of the problem with the friendly one. In the contrary case, the litigation or complaint will fall under the competence of the Court of Nanterre.
Discounts
In case of a promotion, delivery times are longer and returns are not guaranteed.
